{"id":87773,"date":"2026-10-06T12:21:10","date_gmt":"2026-10-06T10:21:10","guid":{"rendered":"https:\/\/forcadell.com\/?p=87773"},"modified":"2026-10-06T12:48:49","modified_gmt":"2026-10-06T10:48:49","slug":"new-asbestos-law-what-changes-for-properties-in-catalonia","status":"publish","type":"post","link":"https:\/\/forcadell.com\/en\/new-asbestos-law-what-changes-for-properties-in-catalonia\/","title":{"rendered":"New Asbestos Law: What Changes for Properties in Catalonia?"},"content":{"rendered":"<div class=\"o-container GenericStyles\">\n<p><strong><strong>The regulation will come into force on 3 October and provides that buyers and tenants receive information about the possible presence of asbestos in the property.<\/strong><\/strong><\/p>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<p>Law 8\/2026, of 2 July, on the eradication of asbestos marks a new step forward in the <strong>identification, removal and management of asbestos-containing materials<\/strong> in Catalonia.<\/p>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<p>Published in the Official Gazette of the Government of Catalonia (DOGC) on 3 July, the regulation <strong>will come into force on 3 October 2026<\/strong>. One of its main new provisions is the introduction of a <strong>certificate confirming the presence or absence of asbestos<\/strong> in certain real estate transactions.<\/p>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<p>This measure may affect property owners, buyers and tenants, as well as homeowners\u2019 associations and professionals involved in property management.<\/p>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<h2 class=\"wp-block-heading\"><strong>A document to be provided in property sales and rentals<\/strong><\/h2>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<p>According to Article 21 of the Law, when a property located in Catalonia is sold or rented, the transferring party must provide the buyer or tenant with a certificate confirming the presence or absence of asbestos.<\/p>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<p>Therefore, <strong>this requirement is not limited to residential property sales<\/strong>. <strong>It also applies to rentals<\/strong> and to the transfer for consideration of any type of property.<\/p>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<p>The aim is to ensure that anyone buying or renting a property has relevant information about the possible presence of asbestos-containing materials before completing the transaction.<\/p>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<h2 class=\"wp-block-heading\"><strong>What must the certificate include?<\/strong><\/h2>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<p>The Law does not yet specify all the practical details of the certificate. These issues will need to be <strong>defined through implementing regulations<\/strong>.<\/p>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<p>In principle, the document must confirm whether or not asbestos-containing materials are present in the property. If asbestos is detected, it is understood that <strong>information should be provided on its location, condition and the potential risk<\/strong> it may pose to people.<\/p>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<p>Given the nature of this assessment, the certificate should be issued by a <strong>qualified technical professional<\/strong>, such as an architect, technical architect or engineer.<\/p>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<h2 class=\"wp-block-heading\"><strong>What happens if asbestos is detected?<\/strong><\/h2>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<p>If the certificate confirms the presence of asbestos-containing materials, this circumstance must be recorded in the <strong>Land Registry<\/strong>, in accordance with the terms established by the Law.<\/p>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<p>By contrast, if the certificate confirms the absence of asbestos, this information would not need to be entered in the Registry.<\/p>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<h2 class=\"wp-block-heading\"><strong>What remains to be clarified?<\/strong><\/h2>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<p>Despite the imminent entry into force of the Law, <strong>several important aspects still need to be defined<\/strong>:<\/p>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<ul class=\"wp-block-list\">\n<li>The final content and characteristics of the certificate.<\/li>\n\n\n\n<li>The requirements and qualifications of the professionals authorised to issue it.<\/li>\n\n\n\n<li>The register of qualified companies and professionals.<\/li>\n\n\n\n<li>Other procedures related to asbestos management and removal.<\/li>\n<\/ul>\n<\/div>\n\n<div class=\"o-container GenericStyles\">\n<p>For this reason, property owners and homeowners\u2019 associations are advised to closely follow the updates published in the coming months.
