Aquesta modalitat d&#039;arrendament permet al ciutad&agrave; optar a un habitatge compartit pagant una renda m&eacute;s baixa que si llogu&eacute;s tot l&#039;immoble. No obstant aix&ograve;, malgrat que el lloguer d&rsquo;habitacions estigui en auge, <strong>la seva regulaci&oacute; manca de legislaci&oacute;, fet que planteja molts dubtes contractuals sobre la seva aplicaci&oacute;<\/strong>. Davant aquest augment de la demanda de pisos compartits, el consistori ha vist la necessitat de regular espec&iacute;ficament aquest model d&#039;arrendament que, fins al moment, s&#039;ha regulat pel Codi Civil i no per la Llei d&#039;Arrendaments Urbans (LAU), com succeeix amb l&rsquo;arrendament d&#039;un pis complet.<\/p>\n<p>&ldquo;En aquest cas &eacute;s important diferenciar entre el lloguer d&#039;habitacions per motiu vacacional o de llarga estada, &eacute;s a dir, superior a 31 dies&rdquo;, afirma Llu&iacute;s Catal&agrave;, soci de Forcadell i director de l&#039;<strong><a href=\"https:\/\/www.forcadell.com\/ca\/juridica\/inici.html\" target=\"_blank\" rel=\"noopener\">&Agrave;rea de Gesti&oacute; Immobili&agrave;ria<\/a><\/strong>, expert en dret immobiliari. &ldquo;En termes contractuals, el lloguer d&#039;habitacions no vacacional &eacute;s molt similar al de l&#039;habitatge complet, encara que <strong>hi ha algunes obligacions i singularitats que l&#039;arrendador ha de tenir en compte<\/strong>&rdquo;.<\/p>\n<p>Segons Llu&iacute;s Catal&agrave;, &ldquo;davant la falta de regulaci&oacute; i la infinitat de pactes que es poden establir entre arrendador i arrendatari, &eacute;s recomanable realitzar un contracte complet en el qual es detalli la m&agrave;xima informaci&oacute; possible sobre el lloguer de l&#039;immoble, a fi de <strong>minimitzar possibles conflictes que puguin esdevenir durant la vig&egrave;ncia del contracte<\/strong>&rdquo;.<\/p>\n<h2><strong>Cl&agrave;usules i condicions pr&ograve;pies del lloguer d&#039;habitacions<\/strong><\/h2>\n<ol>\n<li>\n<p><strong>Un contracte &uacute;nic per a cadascun dels inquilins<\/strong><br \/>\n\tEl propietari d&#039;un pis, o l&#039;arrendatari que decideix llogar habitacions, ha de realitzar un contracte per a cadascun dels inquilins que resideixi a la casa, incloent informaci&oacute; sobre l&#039;habitaci&oacute; arrendada, la forma de pagament, la renda acordada, el temps de durada, l&#039;&uacute;s de zones i serveis comuns, etc&egrave;tera.<\/p>\n<\/li>\n<li>\n<p><strong>El consentiment expr&eacute;s del propietari<\/strong><br \/>\n\tSi l&#039;arrendatari total de l&#039;habitatge decideix subarrendar la resta d&#039;habitacions del pis necessitar&agrave; el consentiment expr&eacute;s i per escrit del propietari del pis. La sanci&oacute; en cas d&#039;incompliment implicaria que el propietari t&eacute; el dret de resoldre el contracte d&#039;arrendament i desallotjar als ocupants del pis, a m&eacute;s de reclamar indemnitzaci&oacute; per danys i perjudicis ocasionats.<\/p>\n<\/li>\n<li>\n<p><strong>Moblament de l&#039;habitatge&nbsp;<\/strong><br \/>\n\tL&#039;arrendament per habitacions obliga a l&#039;arrendador a moblar l&#039;habitatge. &Eacute;s recomanable, per tant, detallar en el contracte el mobiliari de l&#039;habitaci&oacute; arrendada i realitzar un reportatge fotogr&agrave;fic minuci&oacute;s.<\/p>\n<\/li>\n<li>\n<p><strong>L&#039;&uacute;s de zones comunes<\/strong><br \/>\n\tEl contracte de lloguer per habitacions ha d&#039;establir quin&nbsp;&uacute;s es pot donar de les zones i serveis comuns del pis: menjador, sala d&#039;estar, banys, passad&iacute;s i terrassa,&nbsp;entre d&#039;altres zones comunit&agrave;ries. Segons Llu&iacute;s Catal&agrave;, &ldquo;de manera opcional -i cada vegada m&eacute;s comuna- el contracte tamb&eacute; pot establir normes de conviv&egrave;ncia entre arrendataris en l&#039;&uacute;s de les zones comunes, normes molt dif&iacute;cils de poder controlar i aplicar&rdquo;.<\/p>\n<\/li>\n<li>\n<p><strong>La durada del lloguer<\/strong><br \/>\n\tLa durada del lloguer i el temps de m&iacute;nim compliment s&#039;estableixen entre les dues parts i no es regeix pel sistema de pr&ograve;rrogues previst en la Llei d&#039;Arrendaments Urbans. Per tant, cada habitaci&oacute; pot tenir la seva pr&ograve;pia durada del contracte, sent el m&eacute;s habitual 1 any.<\/p>\n<\/li>\n<\/ol>\n<p>Davant d&#039;aquest escenari de llibertat de pactes existents, un contracte ben redactat i complet pot evitar futurs conflictes entre propietaris i arrendataris, i assegurar el bon &uacute;s de l&#039;habitatge i la conviv&egrave;ncia entre inquilins.
